This paper discusses, within the context of analytical theory, some of the implications when rape is subsumed within the international crime of genocide and concludes that this type of enquiry is essential for creating a clearer framework to address and understand this violation. From the analysis undertaken, two critical questions become apparent: a) Does compatibility exist when rape is subsumed within the category of a group violation (genocide), if rape is constructed as a violation of an individual’s sexual autonomy? i (...) b) Is the link between rape and genocide necessarily problematic within this notion of autonomy for the individual victim of rape? The process unfolds within an analytical theoretical approach that touches upon the current concept of human rights with its focus on the individual. Although the key element is the individual, the concept of human rights also creates a space, albeit limited and at times controversial, for the group. As such, this paper identifies some of the theoretical implications that emerge once rape is subsumed within the international crime of genocide, which is defined as a violation committed against particular groups. Lack of understanding about the relationship between federal and state educational institutions brings confusion into discussions of democracy, equity and equality in schools. The 'right to education' continues to be espoused by American society as a birthright, yet it does not figure in federal documentation. This matter has repeatedly come to the attention of legislative courts, who have insisted that the question of education as a fundamental right be addressed. Numerous court cases have attempted to bring closure on this issue, (...) on the basis of such abstractions as national rights, equal access, opportunity and economic disparity among the petitions. However, legal judgments remain inconclusive, reiterating that education remains a state legislative issue. This paper explores the implications of a fundamental right to education through an examination of federal and state legal litigation, discussing the philosophical and ideological roots of discussion of rights and democratic values, and evaluating how federal and judicial participation contributes to overall misunderstanding regarding public schooling. The rise of the idea of the Anthropocene is promoting multiple reflections on its meaning. As we consider entering this new geological epoch, we realize the pervasiveness of humankind’s deconstruction and reconstruction of the Earth, in both geophysical and discursive terms. As the body of the Earth is marked and reshaped, so is its idea. From a hostile territory to be subjugated and exploited through sovereign commands, the Earth is now reframed as a vulnerable domain in need of protection. The (...) mode of sovereignty, which has accompanied human and legal history and practice during modernity and its project of mastery, is no longer useful. Humanity’s control of the Earth is being reimagined and reconfigured along biopolitical coordinates of thought and action. Biopolitics shifts the focus of power, changes its modalities of interventions, and rearticulates its legitimacy on the idea of taking responsibility for the Earth, for nature. A biopolitical re-orientation of law captures the fundamental aim of caring for nature, of fostering its vital possibilities and of enhancing its productive potential. Yet, biopolitics engulfs nature in its entirety under its framework of control, where protection and subjugation, vulnerability and productivity, life and death are constantly entangled in a reciprocal and inevitable relation of indistinguishability. Sovereignty becomes thus a key modality of biopolitical intervention, when nature is recalcitrant, wild, spontaneous, unpredictable, violent, dangerous. Biopolitics, thus, remains caught in an undecidable dilemma, where in order to protect the Earth, it must subjugate it; to save it, it must condemn it. In this respect, biopolitics remains utterly modern, or as argued by Roberto Esposito, modernity has always been biopolitical, insofar as modernity has emerged as a framework for the protection of life against life’s own excesses. But how can we escape the biopolitical reframing and enframing of the Earth and its total subsumption under its matrix of control? How can we rethink the encounter between law and nature without remaining entangled in the aporetic dilemma of biopolitics? An aesthetics of wonder may offer a way. (shrink)

This memoir consists of two parts, of which the first deals with the foundations of the theory of the struggle for existence, and begins with the introduction of the important concept of quantity of life, besides that of population. The fundamental equations are then established for the case where the individuals of a biological association mutually devour each other, the reasoning being based on the principle of encounters and on the fundamental hypothesis of the existence of equivalents of the individuals (...) constituting the different species which form the association.Having now obtained the equations which determine the rates of change of the numbers of individuals and of the quantities of life of the species, the memoir proceeds to find the equations relating to the stationary state, by establishing theorems which are afterwards applied for the purpose of obtaining the three general laws of the fluctuations. This investigation of the equilibrium state is then followed by the determination of the integrals of the fluctuation equations, and the deduction from these of their most important consequences.The second part of the memoir contains the enumeration and demonstration of the general laws of the struggle for existence, which flow from the discussion of the principles and the integrals obtained in the first part. In this way there is established a new sort of dynamics, demographic dynamics, which, though substantially different from the dynamics of material systems, is developed from an analogous point of view.The second part begins with the principle of the conservation of demographic energy, according to which there are two sorts of energy, one actual and one potential, which transform mutually the one into the other. This principle is the analogue of the principle of conservation of mechanical energy. It is followed by the enunciation of the three laws relating to the biological fluctuations, the experimental verification of which has been investigated by several naturalists. The concept of judicial objectivity is a cornerstone of modern legal systems. This article discusses the interplay between the lexical uses of the concept of judicial objectivity in cases that review the judicial impartiality of the court. The data for this project is retrieved from a large sample of cases from Hungary, Italy, Lithuania, Slovakia, Slovenia, Spain and the UK. The analysis of the data shows that in the case of alleged judicial bias, the concept of objectivity is referred to (...) in order to justify a series of judicial activities. In particular, the study provides a strong indication of what Legrand called ‘pre-judices’, which are the cultural aspects that are embedded in the process of the professional socialisation of each legal system. U radu se takodje raspravlja o nekim kanalima kroz koje korupcija urusava ekonomske odluke. Naposletku, u clanku se upucuje na odredjene postupke koje su sprovele pojedine zemlje u svom nastojanju da smanje korupciju i (...) naglasava da se borba protiv korupcije ne moze oslanjati na?magicni metak?, vec da se bitka mora voditi na mnogim frontovima. This contribution addresses some bioethical and medico-legal issues of the opinion formulated by the Italian National Bioethics Committee (CNB) in response to the dilemma between the State’s duty to protect the life and health of the prisoner entrusted to its care and the prisoner’s right to exercise his freedom of expression. The prisoner hunger strike is a form of protest frequently encountered in prison and it is a form of communication but also a language used by the prisoner in order (...) to provoke changes in the prison condition. There are no rules in the prison regulations, nor in the laws governing the legal status of prisoners, that allow the conscious will of the capable and informed subject to be opposed and forced nutrition to be carried out. However, this can in no manner make therapeutic abandonment legitimate: the medical doctor should promote every action to support the patient. In the recent opinion formulated by the CNB it was remarked how self-determination is a central concept in human rights and refers to an individual’s ability to make autonomous and free decisions about his or her life and body. _Contributions to Law, Philosophy and Ecology: Exploring Re-Embodiments_ is a preliminary contribution to the establishment of re-embodiments as a theoretical strand within legal and ecological theory and philosophy. As such, they offer a plurality of alternative modes of theory and practice that seek to counteract the ecocidal tendencies of the Anthropocene. 2Public space is an old habit. The words public space are deceptive; when I hear the words, when I say the words, I’m forced to have an image of a physical place I can point to and be in. I should be thinking only of a condition; but, instead, I imagine an architectural type, and I think of a piazza, or a town square, or a city commons. Public space, I assume, without thinking about it, is a place where the (...) public gathers. The public gathers in two kinds of spaces. The first is a space that is public, a place where the public gathers because it has a right to the place; the second is a space that is made public, a place where the public gathers precisely because it doesn’t have the right—a place made public by force.3In the space that is public, the public whose space this is has agreed to be a public; these are people “in the form of the city,” they are public when they act “in the name of the city.” They “own” the city only in quotes. The establishment of certain space in the city as “public” is a reminder, a warning, that the rest of the city isn’t public. New York doesn’t belong to us, and neither does Paris, and neither does Des Moines. Setting up a public space means setting aside a public space. Public space is a place in the middle of the city but isolated from the city. Public space is the piazza, an open space separated from the closure of alleys and dead ends; public space is the piazza, a space in the light, away from the plots and conspiracies in dark smokey rooms. Starting from MacIntyre’s virtue ethics, we investigate several codes of conduct of banks to identify the type of virtues that are needed to realize their mission. Based on this analysis, we define three core virtues: honesty, due care, and accuracy. We compare and contrast these codes of conduct with the actual behavior of banks that led to the credit crisis and find that in some cases banks did not behave according to the moral standards they set themselves. However, although banks (...) and the professionals working in them can be blamed for what they did, one should also acknowledge that the institutional context of the free market economy in which they operated made it difficult to live up to the core values lying at the basis of the codes of conduct. Given the neo-liberal free market system, innovative and risky strategies to enhance profits are considered desirable for the sake of shareholder’s interests. A return to the core virtues in the financial sector will therefore only succeed if a renewed sense of responsibility in the sector is supported by institutional changes that allow banks to put their mission into practice. Translating ethical theories into clinical practice presents a perennial challenge to educators. While many suggestions have been put forth to bridge the theory-practice gap, none have sufficiently remedied the problem. We believe the ascendance of hospital medicine, as a dominant new force in medical education and patient care, presents a unique opportunity that could redefine the way clinical ethics is taught. The field of hospital medicine in the United States is comprised of more than 50,000 hospitalists—specialists in inpatient medicine—representing the (...) fastest growing subspecialty in the history of medicine, and its members have emerged as a dominant new force around which medical education and patient care pivot. This evolution in medical education presents a unique opportunity for the clinical ethics community. Through their proximity to patients and trainees, hospitalists have the potential to teach medical ethics in real time on the wards, but most hospitalists have not received formal training in clinical ethics. We believe it is time to strengthen the ties between hospital medicine and medical ethics, and in this article we outline how clinical ethicists might collaborate with hospitalists to identify routine issues that do not rise to the level of an “ethics consult,” but nonetheless require an intellectual grounding in normative reasoning. We use a clinical vignette to explore how this approach might enhance and broaden the scope of medical education that occurs in the inpatient setting: A patient with an intra-abdominal abscess is admitted to the academic hospitalist teaching service for drainage of the fluid, hemodynamic support, and antimicrobial therapy. During the initial encounter with the hospitalist and his team of medical students and residents, the patient reports night sweats and asks if this symptom could be due to the abscess. In identifying intrinsic molecular chance and extrinsic adaptive pressures as the only causally relevant factors in the process of evolution, the theoretical perspective of the Modern Synthesis had a major impact on the perceived tenability of an ontology of dispositional properties. However, since the late 1970s, an increasing number of evolutionary biologists have challenged the descriptive and explanatory adequacy of this “chance alone, extrinsic only” understanding of evolutionary change. Because morphological studies of homology, convergence, and teratology have revealed a space (...) of possible forms and phylogenetic trajectories that is considerably more restricted than expected, evo-devo has focused on the causal contribution of intrinsic developmental processes to the course of evolution. Evo-devo’s investigation into the developmental structure of the modality of morphology – including both the possibility and impossibility of organismal form – has led to the utilisation of a number of dispositional concepts that emphasise the tendency of the evolutionary process to change along certain routes. In this sense, and in contrast to the perspective of the Modern Synthesis, evo-devo can be described as a “science of dispositions.” This chapter discusses the recent philosophical literature on dispositional properties in evo-devo, exploring debates about both the metaphysical and epistemological aspects of the central dispositional concepts utilised in contemporary evo-devo and addressing the epistemological question of how dispositional properties challenge existing explanatory models in evolutionary biology. In this paper we study in details a system of two weakly coupled harmonic oscillators from the point of view of Bohm’s interpretation of quantum mechanics. This system may be viewed as a simple model for the interaction between a photon and a photodetector. We obtain exact solutions for the general case. We then compute approximate solutions for the case where one oscillator is initially in its first excited state (a single photon) reaching the other oscillator in its ground state (...) (the photodetector). The approximate solutions represent the state of both oscillators after the interaction, which is not an eigenstate of the individual hamiltonians for each oscillator, and therefore the energies for each oscillator do not exist in the Copenhagen interpretation of Quantum Mechanics. We use the approximate solutions that we obtained to compute Bohmian trajectories and to study the energy transfer between the oscillators. We conclude that, even using the Bohmian view, the energy of each individual oscillator is not well defined, as the nonlocal quantum potential is not negligible even after the coupling is turned off. Hylas replies that, on the contrary, we can and do think of, e.g., a tree standing alone as opposed to a tree being perceived by an observer. According to Berkeley, then, the unconscious process of inference of the scientist goes as follows. He notices that, when he does not have his house within visual range, he cannot see it just by wishing to; and that, when he does have it within visual range and his eyes open, he cannot prevent himself from seeing it just by wishing not to. He therefore infers that he is not the efficient cause of these sensations. But, since he holds that they (...) must have some efficient cause, he concludes that this is a congeries of "material substances," which are numerically distinct and partly dissimilar from the sensations, and which exist even when unperceived, or "externally to the mind." Hitherto, the standard edition of Berkeley's works has been A. C. Fraser's of 1901, published by the Oxford University Press. The chief differences between the two editions are these. Professors Luce and Jessop give of each text the latest edition published by Berkeley himself, adding all significant variations in any earlier editions in footnotes, whereas Fraser followed no uniform procedure, and sometimes combined different editions. This difference is obviously an improvement. Further, Professor Luce's edition of Berkeley's pair of notebooks, which (...) he calls Philosophical Commentaries and which Fraser called Commonplace Book of occasional metaphysical thoughts, differs radically from Fraser's; Professor Luce has also given a different, and better, text of the Theory of Vision Vindicated. Finally, Volume II of the new edition amplifies Berkeley's brief correspondence with the American philosopher, Samuel Johnson, since it contains Johnson's letters to Berkeley, in which he questions some points in Berkeley's system, whereas Fraser published Berkeley's replies only. The editors' notes and introductions are brief, and have been written with the primary aim of presenting an accurate text. This policy is welcome, since it remains all too true that, as Professor Jessop remarks, "hitherto Berkeley has been read far too little, and his expositors far too much"; which, in the case of so excellent a writer as Berkeley, is doubly a pity. The presence and impact of Hispanics/Latinos in the United States cannot be ignored. Already the largest minority group, by 2050 their numbers will exceed all the other minority groups in the United States combined. The diversity of this population is often understated, but the people differ in terms of their origin, race. language, custom, religion, political affiliation, education and economic status. The heterogeneity of the Hispanic/Latino population raises questions about their identity and their rights: do they really constitute a group? (...) That is, do they have rights as a group, or just as individuals? This volume, addresses these concerns through a varied and interdisciplinary approach. (shrink)

Aquinas has been accused of being a sexist for making the following four claims about woman: (1) woman is a deficient male; (2) woman was created only for the purpose of procreation; (3) woman is inferior to man; (4) woman must submit to man. Some scholars, notably Michael Nolan, have attempted to defend Thomas, and a few have even gone so far as calling him a feminist. The aim of this paper is to show that Aquinas did hold these four (...) claims throughout his career, and to show in what sense he held them, thus revealing how well-founded the accusations remain, given the assumptions of feminism. Finally, the authors propose that any future attempt to exonerate Aquinas from the charge of sexism must grapple with the question of how these claims are compatible with a gender-equality view. Although narcissists often emerge as leaders, the relationship between leader narcissism and follower performance is ambiguous and often even found to be negative. For women, narcissism seems especially likely to lead to negative evaluations. Since narcissists have the tendency to be impulsive and change their minds on a whim, they may come across as inconsistent. We propose “inconsistent leader behavior” as a new mechanism in the relationship between leader narcissism and follower performance and argue that leader gender plays an important (...) role in whether narcissistic leaders are perceived as inconsistent. Specifically, we expect leader narcissism to have a negative relationship with follower performance through perceived inconsistent leader behavior, especially for female leaders. Thus, we examine leader gender as a personal factor moderating the relationship between narcissism and perceived inconsistent behavior. Also, as perceived inconsistency is likely less problematic when a good relationship exists, we examine leader–member exchange as a contextual condition moderating the relationship between leader behavior and follower performance. We test our moderated mediation model in a multi-source study with 165 unique leader–follower dyads. As expected, leader narcissism was positively related to perceived inconsistent leader behavior, and this relationship was stronger for female leaders. Inconsistent leader behavior was negatively related to follower performance, but only when LMX was low. Our research highlights that perceived behavioral inconsistency can be problematic and—for female leaders—provides an explanation of the negative relation of leader narcissism with follower performance and of the inconsistencies in evaluations of narcissistic leaders’ effectiveness. Part of being a good professional is, so we contend, to have ideals. Ideals essentially complement the deontic considerations that are usually taken as the main components of professional moral deliberation. Yet the notion of professional ideals is problematic. As professional ideals they refer to a profession collectively, while as professional ideals they are first of all strong personal commitments of individual professionals. As collective aspirations, professional ideals have a kind of external normative thrust on individual professionals, but people cannot (...) be forced to identify with ideals on demand. Endorsing ideals can only come from within. On the basis of an analysis of ?professional ideals? and ?professional identity?, we conclude that professional ideals are necessary constituents of the personal identity of professionals. This explains the dual character of professional ideals: they are pursued by a collective and constitute the group professional identity but they also need to be endorsed by individual professionals in order to be able to say that the ideals are their own. We end with a short and tentative description of some practical implications for the fostering and education of professional ideals. (shrink)

In their Out of Work: Government and Unemployment in Twentieth Century America, Richard Vedder and Lowell Gallaway contend that government intervention in American labor markets has caused unemployment by raising the real price of labor. In my critique of the book, I allowed that while this might sometimes be the case, it is not as important as Vedder and Gallaway claim. Their Reply does not succeed in vindicating their argument, because their wage averages fail to take into account variations in (...) wages within phases of the business cycle; because they fail to take into account the effects of unemployment on potential productivity, distorting their measures of real wages; and because they ignore the vast literature on the subject. This study focuses on the prediction of the engagement of small- and medium-sized enterprises (SMEs) in environmental management practices, based on a random sample of 689 SMEs. The study finds that several endogenous factors, including tangibility of sector, firm size, innovative orientation, family influence and perceived financial benefits from energy conservation, predict an SME’s level of engagement in selected environmental management practices. For family influence, this effect is found only in interaction with the number of owners. Despite societal concerns about the welfare of commercial laying hens, little attention has been paid to the welfare implications of the choices made by the genetics companies involved with their breeding. These choices regarding trait selection and other aspects of breeding significantly affect living conditions for the more than 7 billion laying hens in the world. However, these companies must consider a number of different commercial and societal interests, beyond animal welfare concerns. In this article we map some of the (...) relevant dilemmas faced by genetics companies in order to outline the scope of opportunities to improve welfare under current market conditions. This includes identifying cases where different animal welfare concerns conflict. We discuss the moral responsibility of laying hen genetics companies and the welfare implications that derive from the choices they make and the policies they follow. In addition to evaluating a selection of predominant current practices and breeding goals, we outline different angles from where to assess the moral legitimacy of various industry practices and policies. We discuss specific issues such as injurious pecking, bone health, induced moulting, chick culling and the circumstances of breeding stock. (shrink)
